These Terms of Service ("Terms") govern your access to and use of the SaleStreams platform, website and related services (collectively, the "Services"), provided by SaleStreams ("we", "us", "our"). By accessing or using our Services, you agree to be bound by these Terms. If you do not agree, you must not use our Services. These Terms are governed by the laws of England and Wales.
You must be authorised to act on behalf of your organisation to enter into these Terms. When you create an account, you are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You agree to notify us promptly of any unauthorised use of your account.
You agree to use the Services only for lawful purposes and in accordance with these Terms. You must not:
Access to certain features of the platform requires a paid subscription. Fees, billing cycles and payment terms will be set out in your order form or subscription agreement. Unless otherwise agreed, fees are non-refundable. We reserve the right to change our pricing with reasonable notice.
You retain ownership of all data you submit to the platform ("Customer Data"). You grant us a licence to host, process and use Customer Data solely to provide and improve the Services. You are responsible for ensuring you have the right to share any Customer Data with us and for complying with applicable data protection laws.
The Services, including all software, design, text and trademarks, are owned by SaleStreams or our licensors and are protected by intellectual property laws. Nothing in these Terms transfers any ownership rights to you, other than the limited right to use the Services as permitted herein.
Our platform may integrate with or link to third-party services. We are not responsible for the content, accuracy or practices of any third-party service, and your use of such services is subject to their own terms and policies.
We aim to provide reliable access to the Services but do not guarantee uninterrupted or error-free operation. We may suspend the Services for maintenance, updates or reasons beyond our reasonable control, and will endeavour to give advance notice where practicable.
The Services are provided "as is" and "as available". To the fullest extent permitted by law, we disclaim all warranties, whether express or implied, including any implied warranties of satisfactory quality, fitness for a particular purpose, and non-infringement.
To the fullest extent permitted by law, SaleStreams shall not be liable for any indirect, incidental, special or consequential damages arising out of or in connection with your use of the Services. Our total aggregate liability for any claim arising under these Terms shall not exceed the fees paid by you in the twelve (12) months preceding the claim. Nothing in these Terms limits liability for death, personal injury caused by negligence, or fraud, where such limitation is not permitted by law.
Either party may terminate these Terms in accordance with the notice periods set out in your subscription agreement. We may suspend or terminate your access immediately if you materially breach these Terms. Upon termination, your right to use the Services will cease, and we will handle any retained Customer Data in accordance with our Privacy Policy and applicable law.
We may update these Terms from time to time to reflect changes in our Services or legal requirements. We will post the updated Terms on this page with a revised "last updated" date. Continued use of the Services after changes take effect constitutes acceptance of the revised Terms.
These Terms are governed by and construed in accordance with the laws of England and Wales. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
